The agreement that governs the service

The TenantOps service is provided to organizations under Portfolio Systems LLC's Master Services Agreement, accepted when the organization subscribes. If these terms and that customer agreement conflict, the customer agreement controls.

Who may use the app

The TenantOps app is for staff of organizations that subscribe to TenantOps, using an account the organization’s administrator issued. You must be 18 or older. Your organization decides whether you have access, and may remove it.

Acceptable use

Use the service only for your organization’s property management work. Do not try to reach data you were not given access to, interfere with the service, reverse engineer it, or use it to send messages the law does not allow. Keep your password and multi-factor device to yourself.

Purchases

Subscriptions are sold to organizations on the web, not in the app. The prices, billing cycle, renewal terms and cancellation method are shown at checkout and in the customer agreement. Subscriptions renew automatically at the end of each billing period unless canceled before renewal. To cancel, follow the instructions in the customer agreement or email [email protected].

The content of this site is provided for information. We may change it at any time. Descriptions of the service are summaries; the customer agreement and its documentation describe what is provided.

SMS and call program

Portfolio Systems LLC offers a phone-based sales line answered by an AI assistant. By providing your phone number on a website form and checking the consent box, you agree to receive: (a) one automated text message containing a booking link, and (b) a call from our AI assistant to follow up on your inquiry.

Message and data rates may apply. Message frequency: up to one text message per inquiry. Text STOP to any message to opt out of future texts. Text HELP for assistance. Carrier: Telnyx.

Consent to receive calls or texts is not a condition of any purchase. You may use the website, request information, or subscribe to TenantOps without providing a phone number or consenting to calls or texts.

We do not make outbound sales calls or send marketing texts unless you have given prior express written consent through the form on our website. We do not import call lists and we do not cold-call. Our outbound numbers are scrubbed against the national and Massachusetts Do Not Call registries.

Disclaimers and liability

Except as the customer agreement provides, the website and app are provided as is, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, Portfolio Systems LLC’s total liability for claims arising from the website or app (other than claims arising under the customer agreement, which is governed by its own liability terms) will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim. Neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, regardless of the theory of liability.

Nothing in these terms limits either party’s liability for death or personal injury caused by negligence, for fraud, or for anything the law does not allow to be limited.

The AI is not an emergency service; in an emergency, call 911.

Law, venue and contact

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any action arising from these terms or the service must be brought in the state or federal courts sitting in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
